Fees: rights and emoluments in matters of seizure of property, division, auction and judicial sureties
In terms of seizure of property, partition, bidding and judicial security, the rights and emoluments of the lawyer are fixed on the basis of a tariff determined according to the procedures provided for in Title IV bis of Book IV of the Commercial Code.
They result from the decree of July 6, 2017, applicable to proceedings brought on or after September 1, 2017.
Percentages are applied, by tranche, in consideration of the price/value of the building.
With regard to emoluments:
- 7.397% between 0 and 6500 €;
- 3.051% between €6,500 and €17,000;
- 2.034% between €17,000 and €60,000;
- 1.526% beyond (with application of a VAT rate of 8.5%).
The registration fees correspond to 5.70% of the price with an increase of 2.5%.
Details of the costs inherent in the formalities (publications, declarations, mentions and miscellaneous filings) are given to the client when the file is opened.
